Acceptance

By creating an account or using Cliux ("the Service") you agree to these terms, to the privacy policy and to the acceptable use policy. If you use the Service for an organisation, you confirm you may bind it. If you do not agree, do not use the Service. When you create an account, and again when you buy a plan, you confirm that you accept these terms, and we record which version you accepted and when.

Your account

You must be at least 18, or the age of majority where you live, to open an account. Give accurate registration details, keep your sign-in secure, and tell us if you think someone else has used it. You are responsible for what happens under your account, including what the people you invite do with the access you give them. One person or legal entity may hold one free account.

Your content and ours

What you make on Cliux is yours. You give Cliux only the licence it needs to host, display and transmit your content in order to provide the Service, and nothing more. You are responsible for having the rights to what you upload and for the notices you owe your own visitors.

The platform software, its designs and its documentation belong to Cliux. You may not copy, resell or reverse-engineer the platform itself.

Plans and payment

Building and previewing a site is free. Each site publishes on its own yearly plan, billed in advance through Stripe at the price shown on the pricing page when you buy it; the plan decides what the site may sell and how much room it has. You are responsible for any tax that applies to you.

What your visitors pay your site goes to the payment account you connect: Stripe, PayPal, Square, Mollie or Adyen. That provider processes those payments for you under its own terms, and Cliux takes no part of them.

If a renewal payment fails, Stripe tries it again and the site keeps working for 7 days; if it is still unpaid then, the site is paused, offline but with nothing deleted, until the plan is paid or the site has another plan.

Renewal, changes and cancelling

A plan renews automatically each year until you cancel, and we email you thirty, seven and one day before it does. A first-year discount applies to the first year only; the plan then renews at its list price. A price change applies from your next renewal, and we tell you at least thirty days before it.

Moving to a dearer plan is charged at once for the rest of the year; moving to a cheaper one takes effect at the renewal, and if the cheaper plan sells nothing recurring, the subscriptions your customers hold with the site end with their current period from that day, and each customer is told. Cancelling stops the renewal, and the plan keeps working until the end of the year you paid for; you can stop it, and keep it again before that day, from the Billing page of the site or the workspace. An agency's workspace plan sets its seats, white label and the discount at which it buys its client sites' plans; a change to it reprices those site plans at their next renewal.

Within fourteen days of buying a plan, or of its yearly renewal, write to [email protected] and we refund that payment in full. A domain registered with the plan's free year cannot be returned to the registry: it stays registered to you until it expires, and its registration price is kept from the refund. After fourteen days a payment is not refunded, but the plan keeps working until the end of the year it paid for. If you are a consumer and cancel a plan that renewed automatically, we refund the whole months of that year you have not yet started.

If you are a consumer, the fourteen-day refund above also covers your legal right to withdraw from a contract made at a distance; the withdrawal page explains it and has a form you may use, though an email saying you withdraw is enough.

Domains

A domain you buy through Cliux is registered in your name through our registrar, Namecheap, Inc. You are its registrant, and the registrar's registration agreement, which you accept before the registration, applies alongside these terms. Cliux sells only names nobody holds, at their standard price: never a premium name and never one registered to somebody else.

A paid site plan includes the first year of one .com, .net or .org domain for each year the plan is paid. Any other domain's first year is charged at the price shown before you pay. A name you choose is held for your site while you pay for it: for up to seven days while you choose a plan, and for up to two hours during a checkout. A hold that lapses frees the name for anyone.

If a registration cannot be completed, for example because somebody registered the name first, what you paid for the domain is refunded automatically, or the plan's free year is given back. A registered domain cannot be returned to the registry, so a refund for one is handled as described under Plans and payment.

A domain is renewed one year at a time, and never without your payment. We email a renewal link thirty and fourteen days before it expires, at the renewal price shown on your domains page. A domain that is not renewed expires: the registry may allow a late renewal for a limited time, possibly with a restore fee, and then releases the name, which anyone may then register.

The domain stays yours when a plan ends: its registration runs until it expires, and you can ask [email protected] to transfer it to another registrar under the registrar's and the registry's rules. A dispute over who is entitled to a name is settled under the registry's dispute policy, such as ICANN's Uniform Domain-Name Dispute-Resolution Policy, and registering a name that infringes somebody else's rights breaks the acceptable use policy.

Hire market

On the hire market, site owners hire agencies listed by other companies, not by Cliux. When you accept an agency's proposal, you pay its price by card through Cliux, to the agency's own Stripe account, and the agency's access to your site opens once the payment goes through, for the dates and at the role in the proposal. Cliux keeps 10% of each payment as its service fee, taken from what the agency receives; you pay the agreed price and nothing on top of it.

The agency is the seller: it does the work and answers for it, and refunds are its to give; the service fee on a refunded part goes back to the agency. A payment that arrives for a proposal that is no longer open (cancelled, expired, or for a site whose team is full) is refunded to you in full. Work found on the hire market is paid through Cliux: an agency that asks to be paid for it any other way may lose its listings, and you can tell us at [email protected].

An agency offers work on the hire market under the hire market agreement with Cliux, which its owner accepts before the agency publishes a listing or sends a proposal.

Plugins from other companies

Plugins in the plugin market are made by other companies, not by Cliux. Each plugin's page says what it may do on your site, which servers it contacts and whether it measures visitors, and installing it agrees to that list. Cliux reviews every version before it runs on any site but the developer's own, and can stop a plugin at once; the developer is responsible for the plugin, and for their own terms and privacy policy, linked on its page.

A paid plugin is sold by its developer, per site, as a subscription through Stripe on the developer's account. The developer is the seller: invoices come from them and refunds are theirs to give. Removing a paid plugin ends its subscription at the end of the period you paid for, with no further charge. If a plugin's payment fails, it keeps running for 7 days, then stops on your site until it is paid. While Cliux has stopped a plugin, its subscription is paused and nothing is charged.

Availability

Cliux runs on a single server. There is no uptime commitment and there are no service credits, and we do not publish measured availability figures; the service commitments page says what we do promise. We announce planned maintenance in advance when we can. We are not liable for downtime caused by things outside our reasonable control, including a provider's outage or force majeure.

Support and the help chat

Cliux gives support by email, through the contact form and in the help chat on the Cliux website and in the console. The help chat, including any answer an AI model writes in it, gives general information about using Cliux. It cannot change your plan, your payments, your data or these terms, and nothing it says is a promise or an offer from Cliux. Where an answer in the chat differs from these terms, the pricing page or your invoice, those apply. For anything about your own account, payments or data, ask the chat for a person or write to [email protected].

Ending the agreement

You can move a site to the trash, or delete a whole agency, from the console at any time. A site goes to the trash once its plan has stopped renewing: it goes offline at once, its plan runs to the end of the year paid for, and it is deleted for good 90 days later unless you restore it. Deleting an agency ends the plans that belong to it. To stop a plan without deleting anything, choose Stop renewal on the Billing page of the site or the workspace, or write to [email protected]: it does not renew, and keeps working until the end of the year you paid for. There is no self-service export of a whole site yet, so ask for a copy of your sites BEFORE you delete them and we send you one.

We may suspend or end your account for a serious or repeated breach of these terms or the acceptable use policy, or for non-payment. We may also end a paid account for any other reason with thirty days' notice, and then refund the whole months of the year paid for that are left. When the agreement ends, your right to use the Service ends with it.

Liability

To the extent the law allows, Cliux is not liable for indirect, incidental, special or consequential loss, and its total liability for any claim under these terms or the Service is capped at what you paid us in the twelve months before the claim.

None of these limits applies to loss caused by our intent or gross negligence, to death or personal injury, to our obligations under data protection law, or to rights a consumer has under the law where they live, which no contract can take away. Some jurisdictions do not allow these limits at all, in which case they apply to you only as far as they are allowed.

The Service as it is

Cliux is provided as it is and as available. Beyond what these terms and the service commitments page promise, and beyond what the law gives a consumer, we make no promise that the Service will meet a particular need, run without interruption or be free of errors.

Your responsibility for your content

You are responsible for what you publish and for how you use the Service. If someone makes a claim against Cliux because your content or your site breaks the law or somebody else's rights, you cover the cost Cliux reasonably bears to answer it, to the extent the law allows and as far as the claim arose from you. This does not apply to a consumer where the law forbids it.

Governing law

These Terms are governed by the laws of the Republic of Turkey. Cliux is not yet an incorporated company, so no company seat or exclusive forum is claimed; ordinary rules of jurisdiction apply, and for EU consumers the mandatory consumer protection law of your country of residence applies where it gives you more.

If you are a consumer in Turkey, you may also take a complaint to the consumer arbitration committee (Tüketici Hakem Heyeti) or the consumer court (Tüketici Mahkemesi) where you live, within the limits the law sets. Nothing in these terms takes away a consumer's rights under the law where they live.

Changes to these terms

When these terms change, the date at the top changes. A change that takes something away from you is emailed to account holders at least thirty days before it takes effect, and the page shows the day it does. If you do not accept it, you may end the agreement before that day, and we refund the whole months of the year paid for that are left; using the Service after it takes effect is acceptance of the new terms.
